Elizabeth,

I am sorry you feel this needs to happen. Based on conversations we had early on in our relationship, I knew the potential for ergo-nurse’s success, which in turn would benefit me and my family. That is why I gave so much and was so willing to work to help you get it to where it is currently. Regardless of what happened to cause this outcome, I would appreciate compensation for the following good I did and help I gave:

1. Worked mid-November 2006 until mid-March 2007 without compensation.

2. Research injured nurses on the internet and found Anne Hudson and requested you send her an e-mail. If you hadn’t sent that and received a response from her, you never would have known to go to the convention in Orlando.

3. While in Orlando I acted upon a prompting which got you your first placement at a major hospital. If I hadn’t acted, you wouldn’t have this great opportunity to place these first units.

4. After the convention I helped you in every way I could to get the units fabricated for less. Not only saving you around $250.00 per unit, also providing you a better piece of equipment.

5. I researched and contacted vendors and found better seatbelt units for less than the amount paid for the originals you were using.

6. I researched and found product liability insurance which will save you thousands of dollars every year.

7. I found a label manufacturer who is printing your “Warning” label for $0.295 each for 1,000 ordered. That is $295.00. You paid $5.00 a piece for your original labels.

Your plan for me months ago was for me to make a minimum of $150,000.00 per year selling these units and training after the sale. That is equal to $12,500.00 per month. I am confident I would have met that income level, thereby providing a good living for my family and your company with an income stream from sales made.

I worked for 4 months to help you get this started. You trusted me and I trusted you. I got the first placement of units in a major facility. Here are 2 options to choose from, both of which I feel are fair. You can pay me for all my time plus some for what I am losing not being able to continue with my contact in Texas which amounts to $38,000.00 by Friday April 27, 2007 at noon in the form of a cashier’s check. At that time I will turn over every lead and contact and we will go our separate ways. Option 2 is you pay me half that amount, or $19,000.00 by Friday, same time, same method. Along with that I will receive 5% of gross sales, indefinitely, made to anyone resulting from my contact in Texas. This means within the Harris Methodist group and / or sales made by my contact to any other facilities or network groups. Also 3% of gross sales, indefinitely, made to anyone resulting from my contact with HCA. This will require me to have full access to any and all sales records on a monthly basis, therefore ensuring nothing is hidden in any way from having to be paid to me.

Again, I did a lot to help get ergo-nurse where it is today and enjoyed doing it. You have a great product and I wish you much success.
